ABSTRACT

Section 144 of the Code of Criminal Procedure (CrPC) in India grants discretionary powers to restrict civil liberties in order to maintain public order. Despite its significance, there has been a lack of critical research on this provision. This research paper aims to fill this void by providing a comprehensive and analytical overview of Section 144 in Delhi over a one-year period. The study examines over 6100 orders passed within the timeframe of 01.01.2021 to 01.01.2022, analyzing the purposes for which these orders are issued and evaluating the effectiveness of procedural safeguards. The research methodology involved filing RTI applications and conducting inspections at various police stations. The limitations of the study are acknowledged, such as incomplete data and a focus on one city. The paper highlights concerns regarding the routine and frequent use of Section 144 orders, suggesting a need for reconsideration of the provision. The report aims to stimulate meaningful discussions and potential reforms surrounding Section 144 of the CrPC and provides the primary data used in the study for wider utilization.
