ABSTRACT

Constitution of India is been endowed with certain rights and duties. The six golden Fundamental rights are considered the magna carta of Indian constitution. These rights are accorded as a privilege in the hands of citizens and non-citizens of India. The court of law is obligated to bestow these rights to the people and if there are rights are infringed then the courts are under the jurisdiction to provide them justice in a just and amicable way. On the contrary if Part III of Indian constitution provides with rights, then Part IV obligates the citizens to some duties as well but which are unjusticiable at all. There are many articles in the constitution which provides a shield for the reserved class people in India. Even after 72 years of independence, our country still faces the problem of inequality. Yes, it is true that everyone is considered equal in the eyes of law but still this reservation system is a hot and ever-growing topic of debate in India. In the British era some strata of people were secluded from the society, they were considered untouchables and were not allowed to the amenities which others were been benefitted with. So, this biasness all started from the British era only. And today the notion to provide this reservation to these backward people classified on the basis of their caste is highly appreciated and which will ensure that every person unlike his caste, religion, gender etc can come up and stand as equals amongst others in the society. Since 1950 many social benefits in the field of education, public services etc are provided to the Scheduled castes, Scheduled Tribes and Backward Classes.
