ABSTRACT
“Childbirth is a gift of god and adoption is an act of god”
Children are believed to be building blocks for a robust India. Parenthood requires love, not DNA so does children who are being always coddled and lead a comfortable life on the other hand parents who surrender, orphan and abandons their child. These children later then become victims of human trafficking and sexual cruelty. Adoption is a process whereby such destitute child will be able to reap the benefits of childhood. Adoption is a beautiful option whereby the parent – child relationship is formed along with couples who are not having children. There is only one personal law called Hindu adoption and maintenance act covering the procedure of adoption. Other religions like Muslims, Parsi Christians do not have separate legislations regulating adoption due to which parents struggled to embrace parenthood. They were eligible only to become the guardian of the child under Guardian and wards act, 1890. This subject matter throws light on the various legislations and also the problems and shortcomings with respect to adoption. It also incorporates the need for uniform civil code to remove the hindrances in this way.
