ABSTRACT
In India cruelty against animals is not much conversed and less explored. Article 21 of the Constitution grants Right to Life to all the Humans. With regard to animals, no statute clearly grants right to animals. The issue is not related with the justice being served rather the cause of concern must be the prevention of cruelty towards mute, innocent animals irrespective of their habitat. Everyone loves animals, then why the cases of animal cruelty are rising day by day. This paper would deal with the rights of the animals and their development in India. In India, the cruelty against animals is governed by the Prevention of Cruelty to Animals Act, 1960. This paper would also interpret the constitutional perspective towards animal cruelty highlighting landmark judgments along with the lacunas in the Prevention of Cruelty to Animals Act, 1960.
