ABSTRACT
The present research study examines the complex obstacles and crucial topics pertaining to migrants who find themselves in distress while at sea. The ongoing occurrence of migration over marine routes has become a prominent global phenomenon, leading to increased focus on the challenges faced by migrants throughout their dangerous travels. This issue has attracted considerable attention from various angles, including humanitarian, legal, and policy considerations. The primary objective of this study is to examine the intricate dynamics among several elements that contribute to distress experienced at sea. These aspects encompass the presence of unsafe vessels, deficiencies in search and rescue efforts, and a lack of effective international collaboration. Through an analysis of case studies and policy frameworks, this study provides valuable perspectives on the human rights infringements encountered by migrants in similar circumstances. Furthermore, the study investigates the legal responsibilities that coastal nations bear in order to guarantee the safeguarding and well-being of individuals migrating across maritime borders. The primary emphasis, however, lies in determining whether these countries are bound by stringent obligations to permit the disembarkation of these people within their borders. The primary objective of this study is to identify an improved approach for addressing the challenge of distressed migrants in maritime environments as well as better methods for rescue and salvage for the distressed vessel and its passengers.
