ABSTRACT
This research paper aims to provide a comprehensive analysis of the practice of Mediation-Arbitration (Med-Arb) in India, with a particular focus on the developments and challenges encountered in the year 2023. Med-Arb, a hybrid dispute resolution mechanism combining elements of mediation and arbitration, has gained significant traction as an effective alternative to traditional litigation in recent years. This paper investigates the evolution of Med-Arb in the Indian legal landscape, examining its legal framework, procedural aspects, and the role of key stakeholders involved in the process. Furthermore, it analyses the advantages and disadvantages of Med-Arb, addresses its efficacy in resolving disputes, and highlights the notable cases and initiatives that have shaped its implementation. By exploring the nuances of Med-Arb in India, this study intends to shed light on its potential for fostering efficient and accessible dispute resolution in the country.
