ABSTRACT

The research paper is concerned with the judicial review power given to the Supreme Court and the High Courts in the judicial system of many countries. The strength of such authority that is based on the doctrine of constitutional supremacy is that it enables the judiciary to assess the constitutionality of legislative and executive acts.

This paper will go through the historical development of the judicial review, conceptual foundation, and its practical effects. The research investigates how the Supreme Court and High Courts exercise judicial power and constitutes its boundaries, and its impact on the delicate balance of the separation of powers in a democracy. The study of judicial review in a chosen jurisdiction is a way to appreciate a complex and situational use of the power by the court.
