ABSTRACT

The right to legal assistance is a critical component of providing access to justice and sustaining the principles of equality and fairness in all legal systems. In India, this right is protected by both constitutional provisions and other legislative enactments. However, the effectiveness and implementation of this right present substantial problems, notably in terms of socioeconomic inequality and institutional capacity. This research study attempts to provide a complete examination of India’s right to legal assistance, looking at its constitutional roots, the evolution of related laws, and its impact on the socio-legal scene.

In India, various efforts have been made in this direction, including the establishment of Lok Adalats. Accused individuals in India have the right to seek legal help if they cannot afford it, as stated in different constitutional articles. This article uses a combination of doctrinal and empirical methodologies to identify existing gaps, evaluate the effectiveness of current systems, and make recommendations for improving access to legal aid services in India. Legal assistance refers to free legal services aimed at promoting people’s wellbeing.
