ABSTRACT
A local restaurant in Trivandum was recently given an interim injunction for making use of the trademarked names of the original restaurant, according to a recent article in the Hindu newspaper headlined “Dindigul Thalappakatti Biriyani wins’ lawsuit in Madras High Court.”
For a long time, the famed restaurant has been litigating for ownership of its infamous trademarks “thalapakattu” and “thalapakatti.” A search on the issue yields a long list of lawsuits filed by the eatery against its imitators.
The legal dispute began in 2011 when a different chain of restaurants called “Thalapakattu Biriyani and Fast Food” used the “thalapakattu” trademark to establish themselves. Consequently, the Dindigul restaurant filed a lawsuit in the Madras High Court for infringment of their “Thalappakattu” trademark.
The paper contains a study of the mentioned case law, which includes a detailed analysis of the events, contentions and the verdict on trademark ownership.
