INTRODUCTION
Due to an increase in the number of privatisations. India has started rapid growth all over the world as a domestic market where the investor of foreign companies can on investing in the huge consumer market which led’s to trademark infringement.
It can be illustrated through an example where a textile and clothing company name Manish is established. They have spent a lot of money on their primary material like cotton, woollen and silk along with the labour work and then advertisement. People are getting aware of the brand and suddenly another company is established with the same brand lets to confuse the customer to avoid the trademark infringement company should be registered under Trade Marks Act.
